LEGISLATIVE UPDATE

Two bills have been filed in the NC General Assembly that could have a direct impact on skilled nursing facilities. The first bill is sponsored by Representatives Julia Howard (R-Davie), Mitchell Setzer (R-Catawba), Becky Carney (D-Mecklenburg), and Marvin Lucas (D-Cumberland), and would require nursing homes, combination homes, and assisted living facilities to have emergency electrical service sufficient to provide heat, lighting, and other essential electrical services to be defined by rules of the NC Medical Care Commission. The second bill, entitled the Health Care Expansion Act of 2019, is sponsored by Senators Joyce Krawiec (R-Forsyth), Dan Bishop (R-Mecklenburg), and Ralph Hise (R-Mitchell) and it would, among other things, repeal North Carolina’s Certificate of Need laws. Both of these bills must still pass both chambers of the General Assembly and be signed by the Governor to become law, and the Association will remain active as these pieces of legislation are considered. REGISTER TODAY FOR PHASE 3 REQUIREMENTS OF PARTICIPATION SEMINAR

Long term care facilities must be compliant with Phase 3 Requirements of Participation by November 28, 2019. This phase introduces several items that have never been surveyed before, including the full implementation of a compliance and ethics and QAPI program, presence of a qualified infection preventionist, and certain staff training requirements.

Cindy Deporter, MSSW, State Survey Agency Director, Division of Health Service Regulation, will be teaching a full day session (three locations) on an overview of Phase 3 Requirements of Participation with extra emphasis on those that have not been phased in (in part). The review will include:

  • Abuse & Neglect Coordination with QAPI Program
  • Care Planning & Providing Culturally Competent & Trauma-Informed Care
  • Standards of Practice, Systems, & Staff Competency Related to Trauma-Informed Care
  • QAPI Program
  • Infection Preventionist
  • Compliance & Ethics Program
  • Bedside Resident Call System
  • Training Requirements

In addition, there will be a segment devoted to the revised State Operations Manual, Appendix Q – Core Guidelines for Determining Immediate Jeopardy. The participant will be able to:

  • Review progress towards meeting the requirements
  • Develop new, or modify existing, action plans
  • Relate survey outcome to the revised Appendix Q
  • Use the Appendix Q modifications to interface with the survey process and consideration of IIDR or IDR
