60 DAY OVERPAYMENT RULE DELAYED

The Centers for Medicare & Medicaid Services (CMS) recently confirmed its plan to postpone implementation of a new rule on collecting overpayments until Feb. 16, 2016, but providers remain on the hook for returning the money before then.

The proposed rule requires Medicare providers to return overpayments within 60 days, a requirement of the Affordable Care Act. In Tuesday’s Federal Register notice, CMS justified the one-year delay because of “exceptional circumstances” regarding the “complexity of the rule and scope of comments.”

SKILLED NURSING FACILITY (SNF) MEDICARE BASICS TRAINING MODULES

Palmetto GBA developed a Skilled Nursing Facility (SNF) Basics educational series that consists of seven Web-based Training modules. These training modules provide an overview of SNF Part A and SNF Part B of A eligibility, billing and coverage, consolidated billing, no payment and exhaust billing, as well as when to submit a generic notice versus an Advance Beneficiary Notice (ABN).

BILLING ISSUE CLARIFICATION

During the reimbursement session at Convention, the following scenario was discussed:

A nursing facility resident went to a hospital emergency department at 10:00 PM. He was not admitted into the hospital as an inpatient, but he was in the ER overnight as an observation stay. He returned to the facility about 12 noon the next day.

According to the Division of Medical Assistance, the facility is able to bill Medicaid for the time the resident was absent from the facility, if the patient was still listed on the facility’s census and was not discharged to the hospital and all of the hospital services will be billed as outpatient services.

It is long-standing policy that Medicare (Parts A and B) or Medicaid providers are not considered to be federal contractors. However, if a provider currently has VA patients, they are considered to be a federal contractor and subject to the Service Contract Act (SCA).
