Sponsored by Young Moore and Henderson, P.A., this program will walk attendees through a case study of a member facility’s successful appeal in 2025 of an F600 / Immediate Jeopardy tag involving harm to the resident caused by a visitor.  

The attorney who represented the facility in the appeal (with permission from the unnamed facility) will explain the incident that prompted the survey, the cited deficiency, CMS’s imposed civil monetary penalty, the facility’s attempt at IDR, the facility’s decision to appeal, and the procedural history of the appeal that culminated in victory through complete elimination of the F600 tag and a refund of the civil monetary penalty in the same year as the citation. This program should be especially beneficial to those individuals who are involved in strategic decision-making at both the facility and corporate levels.
